This Liability Waiver, Release of Claims, and Assumption of Risk Policy applies to all clients, athletes, parents, guardians, guests, and participants who use, register for, purchase, attend, or participate in services, programs, training, events, or activities provided by Trilogy Sports & Fitness.

By using our website, creating an account, purchasing services, booking a session, registering for a program, submitting required forms, signing or electronically accepting a waiver, or participating in services through Trilogy Sports & Fitness, you agree to this policy.

For most questions, account updates, health history updates, injury updates, billing concerns, membership issues, cancellation requests, refund requests, media requests, scheduling issues, or general support needs, clients should submit a support ticket through our Support Request page at https://trilogyfitpt.com/support.

1. Acknowledgment of Participation

Participation in services provided by Trilogy Sports & Fitness may include, but is not limited to:

Sports performance training Strength training Speed and agility training Conditioning Mobility and flexibility work Personal training Semi-private training Group training Youth athlete development Fitness coaching Online coaching Assessments Testing Camps Clinics Warm-ups, drills, exercises, and physical activity Use of equipment, weights, machines, bands, turf, courts, training space, or other facility areas

Participation is voluntary. Clients and athletes may choose not to participate in any activity.

2. Assumption of Risk

Physical training, exercise, sports performance, fitness activity, and athletic participation involve inherent risks.

These risks may include, but are not limited to:

Muscle soreness Fatigue Sprains or strains Bruising Cuts or abrasions Slips, trips, or falls Collisions with people, objects, equipment, or surfaces Equipment-related injuries Overexertion Dehydration Dizziness or fainting Breathing difficulty Heat-related illness Aggravation of existing injuries or conditions Joint, tendon, ligament, muscle, or bone injuries Concussions or head injuries Serious injury, illness, disability, or death

These risks may arise from a participant’s own actions, the actions of others, the condition of the facility, equipment, training environment, weather, instruction, supervision, or other factors.

By participating in Trilogy Sports & Fitness services, clients, athletes, parents, and guardians voluntarily assume all risks associated with participation, whether known or unknown, expected or unexpected.

3. Health Representation and Medical Responsibility

Participants are responsible for confirming that they are physically able to participate in training, fitness, sports performance, and related activities.

Trilogy Sports & Fitness is not a medical provider and does not provide medical advice, diagnosis, treatment, physical therapy, rehabilitation, or medical clearance.

Clients, parents, and guardians are responsible for consulting with a physician or qualified healthcare provider before participation if there is any medical condition, injury, illness, limitation, restriction, pain, or concern that may affect safe participation.

Clients, parents, and guardians are responsible for providing complete and accurate health history, injury history, emergency contact information, and any other information needed for safe participation.

Clients, parents, and guardians are also responsible for notifying Trilogy Sports & Fitness immediately of any injury, illness, pain, medical restriction, change in health status, or other concern that may affect participation.

4. Minor Participants

Trilogy Sports & Fitness provides services that may involve minors and youth athletes.

A parent or legal guardian must approve participation for any minor participant. By registering, booking, purchasing, submitting forms, signing or electronically accepting a waiver, or allowing a minor to participate, the parent or legal guardian confirms that they have authority to act on behalf of the minor.

Parents and guardians are responsible for making sure the minor participant follows all rules, instructions, safety procedures, and behavior expectations.

Parents and guardians are also responsible for providing accurate health history, injury information, emergency contact details, waivers, consent forms, and updated information for the minor participant.

5. Release of Liability

To the fullest extent permitted by law, clients, athletes, parents, guardians, guests, and participants acknowledge that participation in Trilogy Sports & Fitness services involves physical activity and certain inherent risks.

By participating, clients, athletes, parents, guardians, guests, and participants agree that Trilogy Sports & Fitness, its owners, employees, contractors, trainers, coaches, representatives, partners, affiliates, facility owners, landlords, vendors, and agents are not responsible for ordinary risks, accidents, injuries, losses, or damages that may occur as a result of participation in training, programs, events, facility use, equipment use, or related activities.

This includes, but is not limited to, risks related to physical activity, exercise, sports performance training, equipment use, facility conditions, participant conduct, and participation in group or individual training environments.

Nothing in this policy is intended to release Trilogy Sports & Fitness from liability for gross negligence, willful misconduct, or any responsibility that cannot be waived under applicable law.

This policy is intended to be applied only to the fullest extent permitted by law.

6. Indemnification

Clients, athletes, parents, guardians, guests, and participants agree to be responsible for claims, damages, losses, liabilities, costs, or expenses that arise from their own actions, conduct, failure to follow instructions, misuse of equipment, violation of policies, or inaccurate, incomplete, outdated, or withheld health or profile information.

This may include claims related to:

Participation in services A participant’s actions or conduct Failure to follow rules or instructions Inaccurate, incomplete, outdated, or withheld health or profile information Any injury, damage, or harm caused by a participant Violation of Trilogy Sports & Fitness policies, terms, or facility rules

Nothing in this section is intended to require a client, athlete, parent, guardian, guest, or participant to indemnify Trilogy Sports & Fitness for gross negligence, willful misconduct, or any responsibility that cannot be waived under applicable law.

7. Emergency Medical Authorization

In the event of an injury, illness, accident, or emergency, Trilogy Sports & Fitness staff, contractors, trainers, coaches, representatives, or facility personnel may take reasonable action to protect the health and safety of the participant.

This may include, but is not limited to:

Contacting emergency contacts Calling 911 or emergency medical services Providing relevant information to emergency responders Assisting with basic emergency response until professional help arrives Taking other reasonable action under the circumstances

Trilogy Sports & Fitness is not responsible for the cost of emergency medical services, ambulance transportation, medical treatment, hospital care, or related expenses.

Participants, parents, and guardians accept full financial responsibility for any medical care, emergency services, or related expenses resulting from participation.

8. Responsibility to Follow Instructions

Participants are responsible for following all instructions, rules, safety procedures, and guidance provided by Trilogy Sports & Fitness staff, trainers, coaches, contractors, and facility representatives.

Failure to follow instructions may increase the risk of injury.

Trilogy Sports & Fitness reserves the right to stop participation, modify activities, remove a participant, suspend services, or terminate participation if behavior is unsafe, disruptive, disrespectful, inappropriate, or harmful to others.

9. Equipment and Facility Use

Participation may involve the use of equipment, weights, machines, bands, turf, flooring, courts, racks, benches, mats, cones, hurdles, sleds, balls, or other training tools.

Participants are responsible for using equipment and facilities only as instructed.

Misuse of equipment, unsafe behavior, or failure to follow facility rules may result in injury and may lead to removal from services.

Participants may be responsible for damage caused by intentional misuse, reckless behavior, or failure to follow instructions.

10. Communicable Illness and General Health

Participation in group settings, training facilities, camps, clinics, or events may involve exposure to communicable illnesses, including viruses, bacteria, infections, or other contagious conditions.

Participants should not attend training, sessions, camps, clinics, or events while experiencing symptoms of contagious illness, fever, vomiting, severe coughing, or other symptoms that may pose a risk to others.

Trilogy Sports & Fitness may deny participation or ask a participant to leave if illness or safety concerns are present.

11. Photo, Video, and Media Notice

Trilogy Sports & Fitness may take or use photos, videos, testimonials, training clips, or performance highlights for business, marketing, educational, or promotional purposes only when appropriate permission, consent, or release has been obtained.

If a client, parent, or guardian does not want themselves or their child included in photos or videos, they should submit a support ticket through:

Trilogy Sports & Fitness will make reasonable efforts to honor written media preferences, but cannot guarantee removal of content already published, shared, printed, distributed, or posted through third-party platforms before the request was received.

12. Personal Property

Trilogy Sports & Fitness is not responsible for lost, stolen, or damaged personal property.

Participants are responsible for securing their own belongings, including bags, phones, keys, wallets, clothing, shoes, sports equipment, water bottles, and other personal items.

13. Online Coaching and Digital Services

For online coaching, remote programming, app-based training, or digital services, participants are responsible for choosing a safe training environment, using appropriate equipment, following instructions, and stopping activity if pain, discomfort, unsafe conditions, or medical concerns arise.

Trilogy Sports & Fitness may not be physically present to supervise online or remote training.

Participants assume the risks associated with remote, digital, or unsupervised training.

14. Policies Incorporated by Reference

Participation may also be subject to other Trilogy Sports & Fitness policies, including but not limited to:

Terms and Conditions Privacy Policy Refund Policy Cancellation Policy Health History and Profile Information Intake Policy Facility rules Program rules Package, membership, or subscription terms

By participating, clients, athletes, parents, guardians, guests, and participants agree to follow all applicable policies and rules.

15. Support Requests

Submitting a support request does not guarantee approval of any refund, credit, cancellation, package change, hold, participation change, media removal, or other requested outcome.

16. Severability

If any part of this policy is found to be invalid or unenforceable, the remaining portions will remain in full force and effect to the fullest extent permitted by law.

17. Changes to This Policy

Trilogy Sports & Fitness may update this Liability Waiver, Release of Claims, and Assumption of Risk Policy at any time.

When updates are made, the revised policy will be posted on this page with a new effective date.

Continued use of our website, services, programs, or participation after updates are posted means you accept the revised policy.
